Preamble

These Terms and Conditions govern the contractual relationship between PNET SRV, a SASU with a share capital of €1,000.00, registered in the Meaux Trade and Companies Register under number 100 206 143, with its registered office at 1 place de la Libération, 77600 Bussy-Saint-Georges, France, operating the website photonet.app (hereinafter "the Seller"), and any person making a purchase on photonet.app (hereinafter "the Customer").

Placing an order implies full and complete acceptance of these Terms and Conditions.

1. Purpose

The purpose of these Terms and Conditions is to define the terms of sale for services offered by photonet.app, particularly the creation of ID photos compliant with official standards.

2. Services Offered

photonet.app offers the following services:

• Digital format: HD ID photo and sheet of 6 photos to download
• Photo print: professional print on photo paper delivered to your home (Metropolitan France only)

Photos are processed by artificial intelligence to guarantee compliance with official standards of the destination country.

Prices are indicated in euros (€) including all taxes (VAT included at 20%).

• Digital format: €6.95
• Photo print: €9.95 (delivery included)

PNET SRV reserves the right to modify its prices at any time. Services will be invoiced based on rates in effect at the time of order validation.

4. Order Process

To place an order, the Customer must:

1. Upload or take a photo
2. Let the AI process and validate the photo
3. Enter their email address
4. Choose the desired plan (digital or print)
5. Proceed with secure payment

The order is final once payment is validated.

5. Payment

Payment is made online by credit card through the secure Stripe platform. Payment data is encrypted and does not pass through our servers.

Accepted payment methods: Visa, Mastercard, American Express, Apple Pay, Google Pay.

Payment is debited immediately upon order validation.

6. Delivery

6.1 Digital Format

Files (HD photo and print sheet) are sent by email immediately after payment validation. The Customer can also download them from the link provided in the confirmation email.

6.2 Photo Print

The print is shipped by tracked letter to the address provided by the Customer. Delivery fees are included in the price.

Delivery time: shipped within 24 business hours, delivered within 2 to 3 business days (Metropolitan France). Additional delays may apply for international deliveries.

7. Right of Withdrawal

7.1 Digital Format

In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content provided on an intangible medium whose execution has begun with the consumer's agreement.

By validating their order, the Customer expressly agrees that service execution begins immediately and waives their right of withdrawal for the digital format.

7.2 Photo Print

As the photo print is a personalized product, made according to the Customer's specifications, it is excluded from the right of withdrawal in accordance with Article L. 221-28 of the French Consumer Code.

8. Compliance Guarantee

photonet.app guarantees that produced photos comply with official standards in effect for identity documents. This guarantee applies exclusively to documents listed in the "Compatible documents" section of Article 2.

In case of photo rejection by an official government authority in the destination country for non-compliance with official standards, photonet.app commits to fully refund the Customer upon presentation of proof of rejection (official certificate or screenshot of rejection reason).

This guarantee only applies if the original photo provided by the Customer met basic requirements: clear face, well-lit, neutral expression, open eyes.

Rejections due to defects in the source photo (blur, backlight, closed eyes, etc.) are not covered by this guarantee.

9. Liability

photonet.app is committed to providing all necessary care in delivering a quality service. photonet.app's liability is limited to the order amount.

photonet.app shall not be held liable for indirect damages, data loss, or delivery delays beyond its control.

The Customer is solely responsible for the quality and compliance of the original photo provided.

10. Intellectual Property

The Customer retains all rights to the photos they provide. By using the service, the Customer grants photonet.app a limited license to use their photos solely for processing and providing the service.

Website content (texts, images, logos, software) is the property of photonet.app and is protected by intellectual property laws.

Personal data collected is processed in accordance with our privacy policy. For more information, see our legal notice.

12. Mediation

In case of dispute, the Customer may use a consumer mediator free of charge. In accordance with Article L. 612-1 of the French Consumer Code, photonet.app will provide the contact details of the competent mediator upon request.

Consumers residing in the European Union may also consult the list of dispute resolution bodies: consumer-redress.ec.europa.eu.

13. Applicable Law

These Terms and Conditions are subject to French law. Any dispute relating to their interpretation or execution falls under the jurisdiction of French courts.
